1) Acceptance and scope

By accessing or using this website (the “Site”), you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to the Site and its content. Services purchased or booked through the Site may also be governed by separate policies (for example: booking, cancellation, late arrival, gift card, and in-spa rules). When there is a conflict, the service-specific policy controls for that topic.

2) Eligibility

The Site is intended for users who can form a binding contract. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization.

3) Booking, payments, and gift cards

The Site links to third-party platforms, provided by Square, for scheduling, payment, and digital gift cards. When you follow those links, your transaction is handled by Square and governed by their terms and privacy practices. See Square Terms and Square Privacy .

We are not responsible for Square outages, processing errors, or changes in Square’s terms. If you see an issue with a booking or gift card, contact us and we’ll help route you to the right place.

4) Health information disclaimer

Any health or wellness information on the Site is provided for general education only. It is not medical advice and does not replace advice from a licensed clinician.

If you have a medical condition, are pregnant, have a seizure disorder, have open wounds or an active skin infection, or have any safety concerns, consult your clinician before booking and contact us with questions.

5) Site content and intellectual property

The Site and its content (text, images, graphics, logos, icons, audio, and design) are owned by VT Float Away or its licensors and are protected by intellectual property laws.

You may view, download, and print content for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell, or exploit any part of the Site without prior written permission.

6) Acceptable use

You agree not to use the Site for unlawful purposes; attempt to access non-public areas or systems; scrape, harvest, or collect data from the Site using automated means (except standard search indexing); introduce malware; run denial-of-service attacks; interfere with Site operation; misrepresent your identity; or submit false information through the Site.

We may suspend or block access to the Site if we reasonably believe you violated these Terms.

To the maximum extent permitted by law, our total liability for any claim related to the Site will not exceed the amount you paid us for Site access (if any) in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless VT Float Away from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.

11) Governing law and venue

These Terms are governed by the laws of the State of Vermont, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be brought in state or federal courts located in Vermont, and you consent to jurisdiction there.
